House endorses repeal of motorcycle helmet law for most adultsPosted by phrawgh
LegalJEFFERSON CITY, Mo.— State House members are revving up for another run at repealing Missouri’s mandatory helmet law for most adult motorcyclists.

The House gave initial approval Wednesday by voice vote to legislation that would allow people age 21 and older to ride motorcycles without helmets. Another vote would send the bill to the Senate, where its prospects are much dicier.

Although some motorcyclist enthusiasts have pushed for years to repeal the helmet requirement, their efforts typically have stalled in the Senate, where one or two opponents can more easily block bills than in the House.

Motorcycle Builder Given More Time To Work On CasePosted by phrawgh
LegalA Brevard County judge granted attorneys for famed motorcycle builder Billy Lane more time to work on their case.
Lane, 37, faces DUI manslaughter charges in connection with a Labor Day crash that killed motorcyclist Gerald Morelock.
Lane's lawyers said they just got the case six weeks ago.
Meanwhile, Morelock's family filed a civil suit against Lane for pain and suffering. A hearing in that case is set for Monday.

Quebec seeks return of man who says he's a bikers' hitmanPosted by phrawgh
LegalTORONTO -- Canadian authorities have asked Switzerland to extradite a Quebec man who claims to have carried out as many as 26 homicides in Canada on behalf of outlaw bikers.

Gérald Gallant, 56, from the town of Donnacona, near Quebec City, was arrested in his hotel room in Geneva in May.

He was charged with credit-card fraud.

He is expected to land in Quebec on next Monday.

LegalBandidos Wayne Kellestine's latest court appearance was brief and polite, and apparently amused the biker.

"Your name?" asked Justice of the Peace Isaac Condo asked the most notorious of five people charged in the Shedden massacre two weeks ago. Each of the accused faces eight counts of first-degree murder.

"Wayne Earl Kellestine," he said politely, testifying on a video link from the Elgin-Middlesex Detention Centre.

Kellestine emphasized his middle name to distinguish himself from Wayne Forest Kellestine, a man of similar age who was convicted of a string of bank robberies several years ago. In the days following the discovery of eight slain Bandidos, the two men were confused in some reports.

LegalPolice yesterday arrested a Massachusetts man who they say was a bodyguard to a high-ranking member of the Outlaws Motorcycle Club.

Christopher Legere of Dracut, Massachusetts, was the only member of a motorcycle club arrested during a tense day for police yesterday following the funeral for a leader in the state's Hells Angels who was shot dead last Sunday.

Outlaw biker arrested in MorristownPosted by phrawgh
LegalPhillip Morris is wanted for sexual battery and numberous drug charges. Officals describe him as an "outlaw biker."

Morris is affiliated with a violent motorcycle club. U.S. Marshalls tracked him from Florida to East Tennessee.

Investigators have also located a woman who was travelling with Morris. Authorities first believed Morris forced her to go along, but it turns out that she went willingly.

Warren woman gets prison term for killing bikerPosted by phrawgh
LegalDozens of outraged members of area motorcycle clubs packed the pews in a Macomb County courtroom for the sentencing Tuesday of a Warren woman convicted of manslaughter for shooting her estranged boyfriend in the back of the head.

Sherry L. Priemer, 41, was originally charged with first-degree murder in the July 7 killing of Gregory (Sigmund) Getty, 54, a veteran of two tours in Vietnam and a member of the Madison Heights-based Fourth Reich Motorcycle Club. But jurors convicted her of manslaughter after her trial last month.

"As far as I'm concerned, the United States let him down during this trial," fellow Fourth Reich member Herman Borski told the court before Circuit Judge James Biernat handed down the sentence.

Woman Charged with Killing BikerPosted by phrawgh
LegalA Yuba City woman is facing felony manslaughter charges in the death of "Chicago Dave" and at 9 a.m., May 19, will be in Yuba County Superior Court in Marysville for a hearing.

Amanda D. Driggers, 18, was arrested March 10 by Yuba City police. She is charged in the death of David M. Beaver of North San Juan, who died in a highway wreck in a rural area of Yuba County on Sept. 4, 2005.

On March 13, Driggers pleaded innocent in Yuba County Superior Court to two counts of gross vehicular manslaughter, one charging her with driving while intoxicated and the other with driving with gross negligence.

Driggers was released from the Yuba County Jail this week after Judge James Curry on Monday reduced her bail to $75,000. Janet Frye, legal assistant with the district attorney's office, said court records were unclear as to the original amount of bail.

Beaver, 51, was riding his 1994 Harley-Davidson "Fatboy" on Willow Glen Road when Driggers allegedly came wide around a curve and hit him head-on, according to reports from the California Highway Patrol.

Hell's Angels rumble with DisneyPosted by phrawgh
LegalMotorcycle club sues film studio for infringing on its trademark in 'Wild Hogs' movie.

NEW YORK  - The Hell's Angels Motorcycle Corp. is suing a division of Walt Disney, Buena Vista Motion Pictures and a film production company for infringing on its trademark in the development and production of "Wild Hogs," a comedy about middle-aged bikers.
The motorcycle club says in the suit that it never approved Walt Disney Motion Picture Group's use of its trademark, and that the film studio has repeatedly exploited the Hell's Angels name as well as its trademark design featuring a helmeted, horned and feathered skull while publicizing the "Wild Hogs" movie.
Disney (Research) and Tollin/Robbins Productions have repeatedly referred to "Wild Hogs" as a movie about a "group of middle-aged wannabe bikers look(ing) for adventure out on the open road, where they soon encounter a chapter of the Hell's Angels," according to the suit, filed in the U.S. District Court for the Central District of California.
"We believe the suit is without merit," Disney spokesman David Caouette said.
Tim Allen, John Travolta and Martin Lawrence are slated to star in the film, which is expected to start production in late spring.

NATIONAL MOTORCYCLE CLUB VICE PRESIDENT INDICTED ON COCAINE DISTRIBUTION CHARGESPosted by phrawgh
LegalBOSTON -- The vice president of the national chapter of the Diablos motorcycle club has been indicted on charges he sold large quantities of cocaine to an undercover State Trooper, Attorney General Tom Reilly announced today.

A Hampden County grand jury indicted Keith Gallagher Sr., 50, of Chicopee, on three counts each of trafficking in cocaine and drug violations in a school zone, and one count of possession of marijuana. He is due back in Chicopee District Court on January 25. A superior court arraignment will be scheduled at a later date.

Helmet legislation to go before SenatePosted by phrawgh
LegalMassachusetts motorcyclists may have the choice of riding without a helmet as soon as this summer. That's if a new bill passes through the state Senate next month.

The Massachusetts Motorcycle Association has announced that a new piece of legislation, which would make helmets optional, is scheduled to go before the Senate for a vote on Feb. 1.

However, the helmet option won't be available to just anybody. The bill allows helmet choice to adult riders with at least six years of experience or those who take the approved rider education course and have private health insurance or $50,000 in optional medical coverage.

If a new bill passes through the state Senate next month, some motorcyclists in Massachusetts will have the choice of riding without a helmet.

Anyone who violates the law would face a $125 fine, which would go directly to the state's Head Injury Trust Fund Program.

If the bill makes it off Beacon Hill with the governor's signature, the law would take effect July 1.

Police arrest dozens of suspected Hells AngelsPosted by phrawgh
LegalTORONTO -- Senior members of the Hells Angels are alleged to be among several people arrested Wednesday in a major sweep centred in northwestern Ontario that followed a two-year investigation into the biker club, police said.

Police declined to comment on the exact number of people taken into custody, but one officer called the raids a "very large takedown.''

"This operation will have a significant impact on the Hells Angels in Ontario and the local community,'' said Insp. Don Bell, head of the Ontario Provincial Police biker enforcement unit.

LegalKOREA- A housewife and mother of two young sons has mounted a constitutional challenge against a clause banning motorcycles from freeways, arguing that it infringes on the right to equality and the pursuit of happiness. On Wednesday, Seo Jeong-hee hopped on her 1,800cc Honda VTX road bike and delivered her petition against Article 58 of the Roads and Transportation Law by hand to the Constitutional Court. The regulation was adopted to curb traffic accidents.
"You thought I was some kind of speed demon, didn't you?" Seo asked the Chosun Ilbo reporter. "If I were that into burning rubber, I wouldn't have submitted this bill. Actually, Seo is a long way from being a speedaholic. The bike she gets around on tops out at around 220 km/h and she did not even know the model's name, being for some reason convinced it was a Harley Davidson.

Pa. changes motorcycle permit proceduresPosted by phrawgh
LegalHARRISBURG, Pa. - Under a policy that starts Monday, motorcycle riders will have to pass a knowledge test before they can receive their learner's permit.
The learner's permit previously had been issued before the knowledge test was given.
"We want to make sure that anyone learning to drive a motorcycle has the essential knowledge and understanding before riding on the open road," said Allen D. Biehler, state transportation secretary.
Applicants must complete a motorcycle learner's permit application and pay required fees. But now they will take the knowledge test immediately after returning the application. PennDOT will issue a motorcycle learner's permit if the applicant passes the test.
Motorcycle learner's permits issued before Monday will not be affected by the change.

FBI, SWAT Join Forces In Raid On Biker HousePosted by phrawgh
LegalTAMPA - An FBI SWAT team early Tuesday converged on a Tampa house occupied by members of the Outlaws Motorcycle Club.

Carol Michalik, an FBI spokeswoman, said the agents enforced a sealed federal search warrant. No arrests were made. The house is at Hillsborough and Rome avenues.

Doug Brewer, a club member, watched the search from next to his pickup, bearing an "I love my country, but I fear my government" bumper sticker.

LegalCHICOPEE - A 50-year-old Chicopee man - identified as the vice president of the California-based Diablos motorcycle gang - was being held in lieu of $100,000 cash bail or $1 million surety yesterday following his arrest on charges he distributed large amounts of cocaine to an undercover Massachusetts state trooper.

Keith Gallagher Sr. of 183 Rolf Ave. was arrested at his home around 8 p.m. Wednesday by state police assigned to the office of Attorney General Thomas F. Reilly who announced the arrest. State and Chicopee police also seized a sawed-off shotgun, marijuana, drug paraphernalia and 9 mm ammunition.

Connecticut State Police Spokesman Paul Vance said Connecticut State Police and federal Drug Enforement Administration authorities executed 11 search and seizure warrants and also took 15 people into custody on federal and state arrest warrants.

LegalThree leaders of a premier Johnstown tourism event were charged with illegally diverting money to their organization, state police said Wednesday, sending shock waves through the region.

State police said Greater Johnstown-Cambria County Convention and Visitors Bureau kept $52,574.11 from Thunder in the Valley 2005 beer sales that should have gone to two volunteer fire companies.

Lisa Dailey, 40, the bureau’s executive director; Mary Jayne Korenoski, 56, advertising and sales director; and Karen Soliday, 52, special event vending coordinator, are charged with criminal conspiracy. The counts were filed by the state police Bureau of Liquor Control Enforcement.

None of the three women charged is accused of personally benefiting from the beer money, said Supervisor Thomas Manion of the liquor control bureau.

University Police have undertaken an investigation into a Nov. 4 accident involving a patrol motorcycle and two Drexel graduate students on Locust Walk.
The vehicle struck the man and woman at about 3:45 p.m. on Locust Walk as they were walking outside Steinberg-Dietrich Hall.

Police and witnesses at the scene have diverging accounts, but they agree on one important point: the officer was distracted when he hit the pedestrians.

VANCOUVER -- In a significant step in the campaign against British Columbia's Hells Angels, biker David O'Hara was sentenced yesterday to 34 months in jail after pleading guilty to possession of marijuana, cocaine and a loaded semi-automatic pistol.

Mr. O'Hara, 44, is one of more than 30 bikers who have faced charges in the past 18 months as a result of significant recent efforts to undermine illegal biker gangs in the province.

Mr. O'Hara's sentencing comes as part of the first wave of convictions the police hope to see, Julian Sher, who has written extensively on the Hells Angels, said yesterday in an interview.

Biker "gang" members face charges for fatal Nevada casino brawlPosted by phrawgh
LegalLAS VEGAS Two more members of the Hells Angels have been arrested on federal racketeering charges related to a bloody biker brawl in a Laughlin casino hotel.

Jason Peterson was arrested today in San Francisco. Richard Fabel was arrested at his home in Spokane, Washington, yesterday.

Forty-two other people have been charged in the 2002 deadly melee between rival motorcycle "gangs".

Peterson and Fabel are charged with 19 counts of violence in aid of federal racketeering and 13 counts of using and carrying a firearm during and in relation to a crime of violence.

Two Hells Angels and one Mongol died in the brawl. A third Hells Angel was shot to death later on a highway west of Laughlin.

All 44 defendants are scheduled to be arraigned in U-S District Court in Las Vegas on November 16th and 17th.

LegalDAYTONA BEACH -- A Daytona Beach man on parole testified Wednesday that Donald Williams told him he saw a "puff of smoke" when Trooper Darryl Haywood crashed and died behind him Oct 2, 2004, after a high-speed pursuit of a motorcycle on Interstate 4.

Douglas Fowler, 47, was locked up in the same cell block at the Volusia County Branch Jail with Williams, 39, last summer on a parole violation.

Fowler told jurors that Williams shared details with him at the jail about the chase that ended when Haywood's cruiser got a flat tire from metal debris and crashed into a tree.

Year's crackdown on biker gangs puts 45 in court or behind barsPosted by phrawgh
LegalVANCOUVER -- At least 45 members or associates of outlaw motorcycle gangs have been charged with or convicted of criminal offences in B.C. in the last year, a Vancouver Sun investigation has revealed.

Nineteen club members or associates face a variety of charges that include extortion, death threats, producing and trafficking methamphetamine and cocaine, and possessing grenades and illegal firearms.

But the charges cannot yet be celebrated as a major strike at organized crime, because most of them are still before the courts.

LegalA retired Manhattan Supreme Court judge crossing a busy Downtown Brooklyn street at lunchtime was critically injured yesterday by an off-duty cop riding a motorcycle without a license, authorities said.
Paul Bookson, 72, who's also a former state senator, underwent emergency surgery at Bellevue Hospital in Manhattan following the 12:30 p.m. accident in front of the Brooklyn Supreme Court building.

He was in "very critical" condition with two broken legs.

Nevada court sets biker appeal hearingPosted by phrawgh
LegalCARSON CITY The Nevada Supreme Court has scheduled a November 17th pretrial hearing regarding the validity of indictments charging rival Hells Angels and Mongols motorcycle gang members with murder stemming from a 2002 melee in Laughlin that left three bikers dead.
All seven members of the state's highest court, rather than the usual three-judge panel, will hear the case. The court also canceled a hearing previously set for October 12th.

Seven members of the Hells Angels were scheduled to go on trial last month in Las Vegas. But the Supreme Court on July 25th vacated that trial date and decided to examine whether the charges in a 73-count grand jury indictment were too confusing or contradicted each other.

Several members of the Mongol group are scheduled to go on trial next year.

The club members are charged with murder in the deaths of two Hells Angels and one Mongol. They're also charged with battery, assault, conspiracy and aiding and abetting.
